Darwin Alexander Davila-Perez, a Nicaraguan man living in the United States without legal authorization, now faces serious charges following a chaotic attempt to evade capture.

The initial spark ignited when Davila-Perez attempted to purchase a firearm from a local dealer, falsely claiming U.S. citizenship. The transaction was immediately halted upon discovery of his true nationality and immigration status – a clear violation of federal law prohibiting firearm possession by those unlawfully present in the country.

On December 17th, Immigration and Customs Enforcement agents moved to apprehend Davila-Perez for immigration violations. Instead of surrendering, he initiated a dangerous pursuit, refusing to yield when signaled to stop. The situation rapidly escalated into a physical struggle.

Davila-Perez reversed his vehicle, forcefully colliding with a law enforcement vehicle already on the scene. He then abandoned the car and engaged agents in a brutal fight, demonstrating a fierce resistance to arrest.

The indictment details a shocking assault: an elbow to an officer’s face, a desperate attempt to seize an agent’s firearm, a biting attack on an officer’s arm, and a strike to the forehead with a pair of handcuffs. Throughout the ordeal, agents repeatedly commanded him to comply, issuing instructions in both English and Spanish.

Despite the clear and persistent commands, Davila-Perez continued to fight until finally subdued by the agents. The struggle left multiple officers injured, requiring medical attention for bite wounds, scrapes, and bruises.

Now in custody, Davila-Perez awaits the outcome of his case. A conviction could result in a maximum sentence of twenty years imprisonment, alongside a substantial fine of up to $250,000.
