A British Columbia court has certified a class-action lawsuit against the province, alleging a decades-long pattern of negligence that allowed a prison guard to sexually assault hundreds of inmates. The lawsuit claims the province repeatedly ignored credible reports of MacDougall’s misconduct, failing to protect inmates from a known predator. Despite warnings from fellow corrections officers, authorities allegedly chose not to intervene, leaving vulnerable individuals exposed to repeated harm.
Legal counsel for the plaintiffs reports over 500 former inmates have already come forward, with approximately 200 meeting the initial criteria to join the lawsuit. The full scope of the case remains uncertain, as potential victims retain the right to pursue individual legal action.
The allegations detail horrific acts of sexual violence, including unwanted touching, forced oral sex, and penetration. These alleged assaults occurred while MacDougall worked at four B.C. correctional facilities, primarily at Oakalla Prison in Burnaby, between 1976 and 1997.
MacDougall faced criminal charges in 1998, following his resignation from the corrections service. He largely remained unresponsive to numerous civil lawsuits filed against him over the years, consistently proclaiming his innocence.
However, in 2022, a criminal trial resulted in MacDougall’s conviction on charges of sexual assault, indecent assault, and extortion, relating to offenses against five teenage inmates during the 1980s. This conviction lends weight to the claims made in the current class-action suit.
The lawsuit doesn’t solely target MacDougall; it also alleges the province was negligent in its duty to protect inmates and is therefore vicariously liable for the assaults. The claim asserts a systemic failure to act on warnings and implement safeguards against predatory behavior.
